Appoint a trusted representative in Argentina

This is the most important step in the entire process. To sell a property in Argentina without being physically present, you must grant a Special and Irrevocable Power of Attorney to a trusted person who will act on your behalf.

What is a Special Power of Attorney?

It is a notarized legal document that authorizes another person — a family member, close friend or trusted legal representative — to sign on your behalf the documentation required to complete the sale of that specific property. It is "special" because it is limited to that particular transaction, and "irrevocable" to provide the buyer with legal certainty throughout the process.

How to obtain it from abroad? Visit the nearest Argentine consulate or a local notary. Depending on your country of residence:

  • Spain and Italy: Executed before a local notary + Apostille of The Hague + certified Spanish translation if required
  • United States: Before a notary public or at the Argentine consulate + Apostille of The Hague
  • Other countries: Argentine consulate in your country of residence

Sort out your tax status with AFIP (Argentine Tax Authority)

This is the step that catches most Argentines abroad off guard — and the one most likely to cause delays if not addressed early. As a non-resident, the tax process is more complex than for a seller based in Argentina.

Tax Withholding Certificate for Non-Residents (AFIP)

Before a notary can execute the deed of sale, AFIP must issue this certificate. In doing so, the tax authority verifies that you have been compliant with Personal Assets Tax and Income Tax on that property for all non-statute-barred years. Any outstanding debt must be settled before the sale can proceed.

Tax Substitute (Fiscal Representative in Argentina)

As a non-resident, you are required to appoint a fiscal representative based in Argentina who will file and pay Personal Assets Tax on the assets you hold in the country. This is a mandatory figure that must be formally registered with AFIP.

COTI — Property Transfer Offer Code

This is the code AFIP issues when a property is listed for sale. It must be obtained by your representative in Argentina before the transaction can formally begin, and it is a mandatory requirement.

Receiving the proceeds from abroad

If you live in Spain — Modelo 720

If you are a Spanish tax resident and held property in Argentina, you may have been required to declare foreign assets to the AEAT (Modelo 720) when the value exceeded €50,000. Upon receiving the sale proceeds, you will need to demonstrate the origin of the funds. Consult a tax advisor in Spain before closing the transaction.

If you live in Italy

Italy requires the declaration of foreign assets through the RW section of the annual income tax return (UNICO/730). The proceeds from the sale must be declared, and capital gains tax may apply depending on how long the property was held.
